Terms and Conditions

• "Applicable Law" shall include all laws, statutes, ordinances, bills, regulations, guidelines, policies and other pronouncements having the effect of law in all or any applicable jurisdictions, including the Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020, wherever applicable.
• "Content" shall include, without limitation, data, text, written posts, comments, software, scripts, interactive features, graphics, images, photos, documents, audio, video and all other forms of information or data made available on or through the Website.
• "Account" shall mean the account created by the User on the Website (if such account creation is enabled) by providing the Company the information requested at the time of registration.
• "Grievance Officer" shall have the meaning as ascribed to it under Clause 17.
• "Services" shall mean the services as detailed under Clause 4 of these Terms and Conditions.
• "Third Party Policies" shall mean these Terms and Conditions read with policies of third party service providers, as applicable.
• "Third Party Software" shall mean any software or application developed and owned by a third party that the Company may contract with, from time to time.
• "TSPs" shall mean third party service providers, as applicable, whose services are used in addition to or in conjunction with the Services of the Company.
• "User" shall mean any individual or natural person who accepts these Terms and Conditions and who accesses or uses the Website and/or avails the Services.
• "User’s Content" shall mean any Content that the User saves, submits, posts, displays, uploads, shares, or transmits through the Website (where such features are enabled).

These Terms and Conditions apply to the User for accessing or otherwise using the Website and availing the Services. By using the Website, the User indicates agreement and acceptance to all the terms under these Terms and Conditions. By impliedly or expressly accepting these Terms and Conditions, the User also accepts and agrees to be bound by:

• all of the Company’s policies (including but not limited to the Privacy Policy), as amended from time to time; and
• any product disclaimers or other restrictions presented to the User on the Website.

By mere use of the Website, the User shall be contracting with the Company and these Terms and Conditions constitute the User’s binding obligations with the Company.

By using the Website or availing the Company’s Services, the User agrees that the Company may use and share the User’s Personal Information in accordance with the terms of the Company’s Privacy Policy.

The Website and/or the Services are not intended for use by any person under the age of 18. The Company does not knowingly collect Personal Information from any person under the age of 18. If the Company becomes aware that a person submitting Personal Information is under the age of 18, the Company shall, at its option, delete or suspend such User’s Account and related information.

ILM Research is a research and consumer awareness platform. Through the Website, the Company provides information and analysis on insurance plans/products/policies, insurers, features, and related topics, to help Users understand differences and nuances and make informed decisions.

• Services may include:
• Educational information on insurance concepts, insurers, and insurance plans.
• Ratings, scoring, and benchmarking of insurance plans or features based on analysis, study, and research.
• Research tools (including calculators and decision-support tools) that generate outputs based on User inputs and ILM Research’s logic/assumptions.
• Licensing of content, research, ratings, and technology to third parties such as platforms, intermediaries, insurance companies, and training academies, under separate agreements.

Important: ILM Research does not sell insurance and does not act as an insurance intermediary (including without limitation as a web aggregator or a broker). Nothing on the Website should be treated as legal, tax, or regulatory advice. Users should use independent judgment and, where appropriate, consult qualified professionals.

Certain features may require the User to create an Account. The User is responsible for maintaining the confidentiality of their Account credentials and shall be fully responsible for all activities that occur under the Account. The User agrees to notify the Company immediately of any unauthorized use or breach of security.

The Company may suspend or terminate the User’s access to the Account if the User provides information that is untrue, inaccurate, not current, or incomplete, or if the Company has reasonable grounds to suspect the same.

The Website may undergo changes as the Company continually improves features and User experience. Some features may be marked as "Beta" ("Beta Services"). If the User elects to use Beta Services, then:

• Beta Services are pre-release and may not work fully or properly.
• Use of Beta Services may expose the User to unusual risks of operational failures.
• The Company may use the User’s feedback for product development and improvement.
• Information regarding the User’s use of Beta Services and feedback may be treated as confidential by the Company, subject to Applicable Law.
• Beta Services are provided "as is", "as available", and "with all faults". To the fullest extent permitted by law, the Company disclaims all warranties for Beta Services.

The Website and Services are generally available 24x7, except during scheduled maintenance, emergency maintenance, or reasons beyond the control of the Company.

Cancellations:

• Orders for any paid tools or paid reports can be cancelled at any time after purchase.
• Access to the paid tool/report will be removed after the cancellation request is received and approved.
• Contact us at info@ilmresearch.com for refund requests with subject line "Refund Request" and your Order number.

Refunds:

• If cancelled within 48 hours: 100% refund.
• If cancelled between 48 hours and 7 days: 80% refund of the paid value.
• If cancelled after 7 days: no refund will be provided.
• GST would not be refunded in any circumstances, unless required under Applicable Law.

While selecting any of the payment gateways available on the Website, the Company shall not be responsible for or assume any liability in respect of any loss or damage arising directly or indirectly due to lack of authorization, exceeding limits mutually agreed by the User and its bank, payment issues arising out of the transaction, or decline of transaction for any reason whatsoever.

All payments made for the Services on the Website by the User shall be in accordance with the Company’s billing policies. Users shall be entitled to make payment in Indian Rupee.

The Company may monitor the User’s use of the Website/Services (but shall not have the responsibility to do so) to determine whether the User is complying with these Terms and Conditions.

The Company reserves the right to suspend or terminate access to the Website/Services with immediate effect without notice if:

• the Company is required to do so under Applicable Law;
• a third party service provider suspends or terminates services used by the Company;
• the User provides information that is untrue, inaccurate, not current, or incomplete;
• the User is not eligible to use the Website;
• the Company believes the User’s use is in breach of Applicable Law or these Terms;
• the User’s use may compromise or adversely affect the Company’s systems or networks; or
• the User disrupts traffic on the Website or adversely affects the User experience.

User can delete their Account by contacting the Company at legal@ilmresearch.com. Upon such request, a confirmation message shall be sent to the registered email ID of the User within 72 hours, confirming deletion. However, the User’s Personal Information may be retained as required to enable compliance under Applicable Law.

User agrees, undertakes and confirms that its use of the Website shall be strictly governed by these Terms and Conditions. The User shall not host, display, upload, modify, transmit, update or share any Content that is unlawful, harmful, infringing, misleading, defamatory, obscene, invasive of privacy, or otherwise prohibited under Applicable Law.

User shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device or process to access, acquire, copy or monitor any portion of the Website or any Content without prior written consent of the Company. User shall not attempt to gain unauthorized access, probe, scan or test vulnerabilities, or breach security measures.

By using the Website, the User authorizes the Company to collect Personal Information such as name, email address, IP address, and social media profiles (where provided), and to use and/or disclose the same as per the Privacy Policy and where required for compliance with Applicable Law, security, fraud prevention, and enforcement of these Terms.

The User remains solely responsible for User’s Content (where such features are enabled). The Company does not assume responsibility for User’s Content uploaded, saved or shared by the User.

The User is responsible for safeguarding their password and account credentials from unauthorized use. Any person in possession of the User’s password may have the ability to access and modify the User’s Account.

All material on the Website, including research, ratings, analysis, computer code, design, structure, selection, coordination, expression, the look and feel, and arrangement of content, is protected by copyright, trademark and other intellectual property rights. The User must not copy, reproduce, republish, upload, post, transmit or distribute such material, directly or indirectly, without prior written permission.

The Company may use Third Party Software and services provided by third party service providers (TSPs) to operate the Website and deliver Services. The Company may modify, change, or discontinue any Third Party Software at any time.

User’s use of any Third Party Services shall be governed by the terms and conditions and privacy policy applicable to the corresponding third party. The Company shall not be responsible for the information practices of such third parties.

User acknowledges that the Website and Services are provided on an online portal and may be susceptible to downtimes, crashes or technical issues. The Company makes no representation that the Website and Services will be constantly available.

USER SPECIFICALLY ACKNOWLEDGES AND AGREES THAT USER’S USE OF THE WEBSITE AND THE SERVICES IS AT ITS OWN RISK. THE WEBSITE, SERVICES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" BASIS. THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Termination or expiration of these Terms, in part or in whole, shall not limit the Company from pursuing other remedies available to it.

As a condition of use of the Website, User shall indemnify and hold harmless the Company, its affiliates and their respective officers, directors, agents and employees from any claim or demand arising out of the User’s breach of these Terms or violation of Applicable Law or third party rights.

IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE TO THE USER FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THESE TERMS AND CONDITIONS. Subject to the foregoing, the maximum aggregate liability of the Company vis-à-vis any User, regardless of the form of claim, shall not exceed INR 5000.

These Terms shall be governed by and interpreted in accordance with the laws of India. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts at Mumbai.

In accordance with the Information Technology Act, 2000 and rules made thereunder, Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020, the Grievance Officer details are as follows:

In the event of any questions, comments or complaints raised by the User regarding the Website or the Services, the same shall be acknowledged and redressed by the Grievance Officer within the timelines specified under Applicable Law.

If any person believes they may have any information regarding abuse of the Website or Services, please contact the Company at info@ilmresearch.com.

If a court of competent jurisdiction holds any provision of these Terms to be illegal, invalid, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

The Company reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms at any time without prior written notice. The User’s continued use of the Website following posting of changes shall be deemed acceptance of the revisions.
